Good Samaritan Statutes |

Freedom Quest, Inc., thera-chat.com moderators and crisis counselors contribute a voluntary public service to those in need. Our volunteers gratuitously provide emergency assistance, and hereby invoke protection under the Good Samaritan Statutes of the State of Indiana.
Good Samaritan Laws are to encourage people to help others in emergencies. They require that the "Good Samaritan" use common sense and a reasonable level of skill, not to exceed the scope of the individuals training in emergencies. They assume each person would do his or her best to save a life or prevent further injury.
Good Samaritan Laws give immunity from liability to health care providers and volunteer citizens when they are giving emergency care provided the person uses reasonable, prudent guidelines for care using the resources they have available at the time of the emergency intervention. Most states have enacted some form of Good Samaritan law prohibiting a patient from suing a physician or other health care professional for injuries from a Good Samaritan act. To trigger the protection of such an act, two conditions must be satisfied: it must be a volunteer act, and the actions must be a good-faith effort to help.

Chapter 12. Heather Care: Immunity of Persons Rendering Emergency First Aid
IC 34-30-12-1
Sec. 1. (a) This section does not apply to services rendered by a health care provider (as defined in IC 34-18-2-14 or IC 27-12-2-14 before its repeal) to a patient in a heath care facility (as defined in IC 27-8-10-1).
(b) Except as provided in subsection (c), a person who comes upon the scene of an emergency or accident or is summoned to the scene of an emergency or accident and, in good faith, gratuitously renders emergency care at the scene of the emergency or accident is immune from civil liability for any personal injury that results from:
(1) any act or omission by the person in rendering the emergency care; or
(2) any act or failure to act to provide or arrange for further medical treatment or care for the injured person; except for acts or missions amounting to gross negligence or willful or wanton misconduct.
